This blog post seeks to simply inform a prospective DACA applicant about the requirements for DACA, what DACA does, and the evidence necessary to make sure one is eligible for DACA.

1) Come to the United States before your 16 th birthday.
2) Continuously reside in the United States since June 15, 2007 and living in the United States on June 15, 2012.
3) Born on or after June 16, 1981.
4) Graduated from high school or have a GED OR currently enrolled in school (elementary, middle, high, vocational, adult school, ESL etc.) OR honorably discharged from the U.S. Armed Forces.
5) NO conviction of felony, misdemeanors, three or more other misdemeanors, NOT a threat to national security. Basically, no criminal record. If there is any kind of strict liability violation, make sure to speak with an immigration attorney regarding this so you can decide how to proceed.
6) Entered without inspection before June 15, 2012 or lawful immigration status expired as of June 15, 2012.
7) Proof of identity examples include passport, birth certificate, school or military ID etc. Proof you came to the United States before your 16 th birthday can include passport with admission stamp, a I-94 if you have one, school records of schools you attended/attending in the U.S. travel records or medical records etc.
8) Proof of continuous residence through June 15, 2007 and June 15, 2012 examples include rent receipts, utility, cell phone bills, employment records (W-2 forms, pay stubs), birth certificates, dated bank transactions, medical and dental records etc. Proof of student status at the time includes GED certificate, high school diploma, transcripts, report card etc. Proof served in the U.S. military (if served), copies of
military records etc. Any copies of police reports – discuss with an attorney.
9) File the forms I-821D, I-765 (EAD), I-765ws, $465 filing fee, submit documents with translations if not originally in English. Make copies for your own records.
