1) Be in the United States for more than 5 years – since January, 1, 2010 or before.
2) Be in the United States on November, 20 2014 without lawful status.
3) On November, 20 2014, you have a son or a daughter of any age or marital status who is a U.S. Citizen or a legal permanent resident.
4) Have absolutely no criminal record, no conviction of felony, misdemeanors, not a threat to the national security of the United States, and not in removal proceedings.
5) You have to wait until May 19 th , 2015 to apply. You cannot apply now.
6) Documentation proof is extremely important. Bank statements, record’s from doctor’s office to prove 2) above, birth certificate of son or daughter, passport, naturalization certificate, green card to prove 3) above. Your own proof of identity. Proof of living through the date mentioned in 1) above and this can include rent receipts, medical records, bank statements, tax records etc. Any criminal records. Collect documentation for now.
7) Deferred action means you are protected from deportation. If you qualify, you get a work permit to work and earn income. Deferred action is not permanent resident status.
8) If you are in removal proceedings or have pending criminal charges, you must consult with an immigration lawyer. The immigration law offices of Varun Luthra and their expertise in removal proceedings can guide you.
9) DAPA is currently on hold due to a decision issued by a Texas federal judge. This will delay the implementation of DAPA, however, this does not impact DACA. For more information, read our opinion about the DAPA delay.
