A Ohio immigration lawyer can review your circumstances to determine if you are eligible for an investor’s visa. In order to be able to come to the United States based on an EB5 investor visa:

  • You must invest, or be in the process of actively investing, either $500,000 dollars or $1 million dollars in a U.S. enterprise depending on the area where the business will be opened and operated.
  • You must be actively engaged in the day-to-day affairs of running the business, including policy formation and decision-making for the enterprise.
  • The U.S. business that you are investing in must employ at least 10 U.S. citizens or at least 10 immigrant workers. The foreign national investors and his or her immediate family members do not count among the 10 U.S. citizens that the business must provide employment for.
  • The employment opportunities the business creates for U.S. citizens must exist within a two-year conditional long-term permanent resident period.

EB-5 investors will first obtain lawful permanent resident (LPR) status that is valid for two years. At the end of this period of time, the foreign national investor will be required to file a separate application with United States Citizenship and Immigration Services (USCIS) in order to remove the conditional status and become a regular long-term permanent resident with a green card.
