Simply put, if you are willing to invest $500,000 or a million dollars capital investment amount in to a U.S. enterprise by creating or preserving at least 10 jobs for U.S. workers you can obtain the visa.

The minimum amount of capital is $500,000 if you can invest in a targeted employment area (TEA). In order to receive a TEA designation, you must invest in a rural area or a high unemployment area. The 10 jobs must be created within a two-year period of receiving the conditional permanent residence status. The burden of proof is on the investor to show that the investment has led to the creation of these jobs – in a for-profit commercial entity.

In a rural area, the investment must be made in any city or town with a population of 20,000 or more.

Direct jobs are those that been created directly by the EB-5 investment. Indirect jobs can be included only if there is an association with the EB-5 regional center.
