U Visa was created in order to help the crime victims to secure a legal status in the United States who are undocumented or do not have any valid immigration status in the United States.
Many a times victims of domestic violence, robbery, rape, kidnapping or any other felonious assault do not know that they can be eligible to file for a U Visa. I have personally come across many cases where the victims will come after years stating we were crime victim and we did know we can take benefit under this act.
Who is eligible for U Visa?
If you have suffered or had been a victim of any kind of felonious assault, suffered mental or physical injury, able to provide any credible information pertaining to the crime to the law enforcement agency pertaining to investigation or prosecution of the crime can apply for a U Visa. There is a cap of 10,000 U Visas per year. Additionally, there is a huge backlog with U Visas.
It might take over 4-5 years to get your U Visa approved after it is filed due to the backlog.
If you have been a victim of any crime that falls into U Visa category. Please contact Law Offices of Varun Luthra.
